California’s Workplace Violence Prevention Law and Your Business Coverage

Since July 1, 2024, most California employers have been required to have a written workplace violence prevention plan. The requirement comes from Senate Bill 553, now part of the California Labor Code, and it applies to many small businesses across El Dorado County.

Your Workplace Violence Law Questions, Answered

Who has to follow the law?

Most California employers are covered. Limited exceptions apply, such as certain workplaces that aren’t open to the public and have fewer than 10 employees present at any time, employees working remotely from a location of their choosing, and certain health care settings that follow a separate Cal/OSHA standard.

What does the plan need to include?

In general terms, employers need a written plan that identifies and addresses workplace violence hazards, explains how employees can report concerns without retaliation, and describes how incidents will be responded to and investigated.

Are there training and recordkeeping rules?

Yes. Employers generally must provide training when the plan is first put in place and then annually, keep a log of violent incidents, and maintain related records for set periods.

Who enforces it?

Cal/OSHA enforces the requirements and has been working on a permanent standard. Check Cal/OSHA’s resources for the most current guidance.

Where Insurance Comes In

  • Workers’ compensation generally covers employees injured on the job, including in violent incidents.
  • General liability may respond to claims from customers or visitors, though some policies limit assault and battery claims.
  • Employment practices liability can help if an employee alleges retaliation for reporting a concern.
  • Specialty workplace violence coverage is available from some insurers and may help with crisis response and related costs.
